Introduction

  1. These terms of use (“Terms”) govern your access and use of this website which is operated by Tenant’s Guide, ABN 98 047 744 138 (“we”, “us”, or “our”).
  • By accessing and using this website, you agree to be bound by these Terms.  If you do not agree with these Terms, you must not access or use this website.
  • We reserve our right to change these Terms at any time, without notice to you.  When we change these Terms, we will also update the “Date of last update” at the top of these Terms.  You should check this page occasionally to ensure you are familiar with any changes.

Using Tenant’s Guide website

To use the Tenant’s Guide website, you must be over 18 years old. You agree that you have resided in under a legal and valid tenancy agreement and that you will not:

  • violate any laws;
  • be false or misleading;
  • post any threatening, abusive or defamatory;
  • copy, modify, or distribute any other person’s content without their consent;

If we think that a user is creating problems with our Terms of use, we can at our discretion refuse, delete or take down content that we think is inappropriate or breaching these Terms of use. We also can at our discretion restrict a user’s usage of the services either temporarily or permanently, or do not approve a user’s registration.

Intellectual property rights

  • All intellectual property rights (including copyright and trademarks) in the content and design of this website are owned by us.
  • You may, for personal use only, print a copy of any part of this website to view it.  All other use, copying or reproduction of any part of this website is prohibited without our prior written approval.

  • This website may provide links to other websites. This is done for your convenience only.  We take no responsibility for the accuracy or currency of the information on those sites.  We do not endorse any information, goods or services referred to within those sites, and our provision of these links should not be taken as an endorsement.

For Agencies and Landlords

  • If you are an Agency or Landlord and feel that a review of your business or property is fake or misleading – you can submit a dispute through Tenant’s Guide website. We ask that you provide evidence proving your ownership, including but not limited to a copy of the business registration (for Agency), property/land title document in your respective state or territory (for Landlords), along with a copy of your drivers license.  We will not keep your documents in any way following verification.
  • If you have a well substantiated reason to believe that a review is false, misleading or defamatory, you can Submit a dispute including the evidence to prove that the review is false, misleading or defamatory and we will do the best that we can to make a judgement on whether the review is in fact false, misleading, defamatory, or not the reviewer’s honest opinion.
  • Though it is clearly inappropriate for Tenant’s Guide to remove negative reviews simply because you made a complaint, we will contact the reviewer to inform them about your opinion and will give them 10 calendar days to respond. We may choose to remove or retain the review in this platform after our investigation.

    If we find the tenant’s review is genuine, by law we cannot remove the negative review. You cannot send us further evidence proving that the review is false or misleading in case we do not remove the review in question. If you are dissatisfied with our decision, you have the right to make a complaint to the Office of the Australian Competition & Consumer Commission by phoning 1300 302 021.
  • If your evidence suggests that the review is false, misleading or defamatory or does not reflect a genuinely held opinion, we will remove the review.

Fees

There is a nonrefundable fee of $125 to delete a review from the reviewer.

1. Reviewer need to submit an order for your review to be deleted.  Reviewer need to use the email address that they used when they submitted the review and provide the Review ID at the “Add your note” bottom section of the checkout page.

2. Once we received your request, we will send you an email to verify your email address to confirm that you are the person who submitted the review. If everything is verified, we will remove your review. If you do not respond to the email verification, your review will not be removed.

If a landlord or agency purchased a reward to the reviewer. Tenant’s Guide withholds 20% of the total amount paid to the reviewer. Of that 20%, we can maintain, expand and improve the Tenant’s Guide platform. The reward ranges from $40 to $120. So, if the purchased reward was $50, the reviewer will receive $40. If the purchased reward was $150, the reviewer will receive $120.

Limitation of Liability

  • We are not liable to you on any basis (including negligence) for any loss or damage (however caused) arising out of or in connection with your use of this website or its contents.
  • We accept no liability for any opinion, review, feedback, rating or other statement posted by third parties on our site in relation to you personally, your business, any property, or otherwise contained in any of the Content.  Any views expressed do not necessarily represent our views.  You acknowledge that it is reasonable for us to exclude our liability in relation to the Content as the purpose of the site is to provide honest feedback from tenants regarding Properties and Businesses, and by registering to use the Service you accept the risk of such Content representing you in a negative light.
  • You agree not to hold us legally responsible for the submitted reviews in this platform, including potentially misleading, false or defamatory reviews. We are not liable for the posting of any unfavourable, unlawful, threatening, abusive, defamatory, or material of any kind by a user of the Service which violates or infringes upon your rights.

Release

  • If you have a dispute with one or more Tenant’s Guide users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes. 

Disclaimer

  • If you choose to use the website, you do so at your own sole risk.
  1. We make no representation that anything offered through the website is available for use in other locations, or that it complies with laws and regulations of other locations.
  2. We make no warranty that the website will meet your requirements or be available on an uninterrupted, secure or error-free basis.
  3. We make no warranty regarding accuracy, timeliness, truthfulness, completeness or reliability of any content obtained through the website, or that this website is free of viruses or other harmful components.

Indemnity

  • To the fullest extent allowed by law, you agree to indemnify us from and against all actions, claims, suits, demands, damages, liabilities, losses and expenses (whether in tort or in contract) arising out of or related to your use of this Website.

Privacy policy

  • We are committed to protecting your personal information. Please refer to our Privacy Policy which describes how we collect and manage your personal information.  By agreeing to and accepting these Terms, you also agree to and accept the terms of our Privacy Policy.

Severability

  • If any part of these Terms is held to be illegal, invalid or unenforceable by a Court of law, the legality, validity and enforceability of the remaining parts will not be affected.

Waiver

  • Any failure or delay by us to enforce any provision of these Terms will not be interpreted as a waiver of our rights or remedies.

Termination

  • These Terms are effective until terminated by us, which we may do at any time and without prior notice to you.
  • Any rights or obligations that have accrued up to and including the date of termination will survive.

Governing law and jurisdiction

  • These Terms, and all related matters, shall be governed and interpreted by the laws of New South Wales, Australia.
  • Any dispute under these Terms shall be subject to the exclusive jurisdiction of the Courts of New South Wales, Australia.
